Trump, the travel ban and facts


The lawyers for Trump worked hard to defend the travel ban, first and second version, as a mere pause to study extreme vetting procedures. The Federal trial court and 4th Circuit did not buy the defense. The courts looked at the words and evidence that Trump was out to ban Muslims, as he said.

Now Trump's lawyers are asking the US Supreme Court to buy the nice theory, but the problem is Trump is killing the strategy with his tweets. He wants the travel ban to be called a travel ban to keep out the dangerous terrorists. The legal theory also has a problem as Trump says extreme vetting is in place now, eliminating the whole reason for a travel ban and the need for an emergency appeal to overturn the injunctions.

No wonder attorneys do not want to have Trump for a . He is not manageable.

Some suggest he is deliberately sabotaging the appeal so he can blame the courts for any terrorist attacks and harm the judiciary reputation.

Trump even suggested on Twitter that the Supreme Court could improve his executive order by making it tougher. Courts do not work like that normally. An executive order stands or falls, it is not amended to improve it by a judge or court.

The Supreme Court could duck the whole issue as the executive order is almost over for the 90 day pause from March 2017. The facts do not favor Trump. The attacks on the judges do not favor Trump. The anti-Muslim comments do not favor Trump. Will the US Supreme Court overlook Trump's statements and uphold deference to a national security claim that is not based on rational and factual info?

Do we have the rule of law, or the rule of Trump? Trump is teaching us about the value of our system and the checks and balances we have. My guess is the Supreme Court will take the case, and allow the injunction to remain in place. Trump is free to try a travel ban 3.0....
